CONTACTING MEMBERS BY MAIL OR TELEPHONE 1. If the primary purpose of a mailing to the general membership is not to solicit donations, but rather to provide information and generate action, then the approval of the Rocky Mountain Chapter Executive Committee is not required. The chair of the appropriate Rocky Mountain Chapter committee has the authority to approve such mailings organized at the Chapter level. For example, a conservation alert which provides information about an issue, asks for letters to be written, and then asks for funds to help defray the costs of the mailing would not require the approval of the Rocky Mountain Chapter Executive Committee, nor would a letter inviting members to attend a fundraising event or to buy or sell raffle tickets. Invitations to an event whose proceeds would go solely to another organization do not require Chapter Executive Committee approval provided that, in the judgment of the Chapter Administrative Committee: a) the event furthers the conservation goals of the Chapter, and b) raising funds is not the predominant purpose of the event. Groups or Sections may choose to have stricter rules governing this kind of mailing organized at the Group level. 2. At no time may any Sierra Club entity within the Rocky Mountain Chapter make a mailing for the primary purpose of soliciting donations, with the exception of the Rocky Mountain Chapter Fundraising Committee which is authorized to make one direct mail appeal per year during the month of March, consistent with the policies of the national Sierra Club. 3. Telephone calls made to the general membership in which donations are not requested do not require the approval of the Rocky Mountain Chapter Executive Committee. Just as for mailings, the chair of the relevant Rocky Mountain Chapter committee has the authority to approve telephone calling organized at the Chapter level. Calls in which members are asked to participate in fundraising activities do not require the approval of the Rocky Mountain Chapter Executive Committee. Groups or Sections may choose to have stricter rules governing this kind of telephone calling organized at the Group level. 4. Telephone solicitations in which donations are requested are subject to the following restrictions. These restrictions apply to the calling of any list of more than 25 members. A. From February through April, Groups may call their members for fundraising purposes only in conjunction with the Rocky Mountain Chapter's annual direct mail appeal. The proceeds will be divided between the Rocky Mountain Chapter and the Group. Exceptions to this rule require the approval of the Rocky Mountain Chapter Executive Committee. B. Groups must inform the Rocky Mountain Chapter Fundraising Committee before initiating any telephone fundraising activity any time of the year. Before any telephone fundraising is initiated at the Chapter level, the entity responsible must inform the Rocky Mountain Chapter Fundraising Committee and chairs of all Groups within whose boundaries the calling will be done. C. A Group doing telephone solicitation any time from May through January may call only those Sierra Club members who live within its boundaries, unless it has the approval of the Groups within whose boundaries it is calling. D. Telephone solicitation which is organized at the Chapter level and has no connection to the March direct mail appeal requires the approval of the Rocky Mountain Chapter Executive Committee. E. The lists of people to be called must be purged of members who have indicated either to the national Sierra Club or to the Rocky Mountain Chapter that they do not wish to be called. Names of members who state during a call that they do not wish to be called again should be sent to the Rocky Mountain Chapter Fundraising Committee for eventual transmittal to the national Sierra Club. F. To comply with the requirements of the Pickle Bill, all callers must state (near the time they ask for money) that donations to the Sierra Club are not tax-deductible as charitable contributions. 5. If telephone solicitation is performed by paid solicitors rather than Sierra Club volunteers, the following additional restrictions apply. A. The contract with the solicitor must receive approval by the Rocky Mountain Chapter Executive Committee (unless the Rocky Mountain Chapter approves a standard contract and the standard contract is used). B. The steps described in Volunteer Leadership must be taken to safeguard the confidentiality of the list. C. The goal of any telephone solicitation performed by paid solicitors shall be for the entire expense of the telephone solicitation to consume no more than half the money raised. 6. For any type of mailing or telephone calling a Group wishes to make to Sierra Club members outside its boundaries, that Group must obtain either the approval of the other Groups involved or the approval of the appropriate Chapter entity which could authorize such an activity at the Chapter level.
